Terms and Conditions

1. Purpose

These Terms and Conditions (“Terms”) set out the agreement between YAK Consulting Ltd, a limited company registered in Scotland (“we”, “us”, “our”), and you, the client (“you”, “your”).

By confirming a booking, signing an agreement, or making payment, you agree to these Terms.

We may occasionally work with trusted associates, team members, or subcontractors under the YAK Consulting Ltd umbrella to deliver services. All such work remains under our responsibility and bound by these Terms.

2. Services

YAK Consulting Ltd provides business consulting, strategy, leadership, and operational support services, including sessions, retainers, and bespoke solutions as outlined in our service offerings or agreed in writing with you.

Each engagement is tailored to your needs and may include meetings, workshops, written materials, and follow-up communication as agreed. Any additional work or changes to scope will be agreed in writing before being undertaken.

Communication outside agreed sessions will be responded to within reasonable working hours unless otherwise agreed.
All services are delivered remotely unless otherwise agreed in writing.

3. Bookings & Payments

  • All sessions and retainers must be paid in full before the session takes place, unless otherwise agreed in writing.

  • Payment is made via invoice (issued through Zoho) and processed securely through Stripe.

  • Retainers are billed monthly on an agreed recurring date and are payable immediately upon invoice.

  • Pre‑paid sessions must be used within 6 months unless otherwise agreed.

  • Prices are stated in GBP (£).

  • YAK Consulting Ltd is not currently VAT registered. No VAT will be charged.

4. Cancellations and Rescheduling

  • You may reschedule a session with at least 48 hours’ notice without penalty.

  • Cancellations made with less than 48 hours’ notice may be charged in full.

  • In extenuating circumstances (e.g. illness, family emergency), refunds or reschedules may be offered at our discretion.

  • If we need to reschedule for any reason, we’ll give as much notice as possible and agree on a new date that suits you.

5. Refunds

Refunds are not routinely offered once work has commenced, as our services involve dedicated preparation and delivery time. However, we will always act reasonably in situations of genuine hardship or exceptional circumstances.

6. Confidentiality 

All information you share is treated as strictly confidential. We will not disclose any details of your business, finances, or plans to third parties without your consent, unless required by law.
You agree to keep any materials, templates, or frameworks we provide for your personal or business use only.

7. Intellectual Property

All materials, tools, or frameworks provided during our work remain the intellectual property of YAK Consulting Ltd unless otherwise stated. You are welcome to use any materials for your own internal business purposes but not for resale or redistribution.

8. Limitation of Liability

Our services are designed to guide and support your business decisions but do not constitute legal, financial, or accounting advice.

We will not be liable for any loss of profits, revenues, or indirect damages arising from the use of our services. Our total liability shall not exceed the amount paid for the service in question.

Nothing in these Terms limits liability for fraud or anything else that cannot be limited under Scottish law.

9. Termination

Either party may end an ongoing arrangement (such as a retainer) by providing 30 days’ written notice. Work already completed or booked will be invoiced and payable in full.

10. Data Protection and Privacy

We handle all personal and business information in accordance with the UK GDPR.
Your information will only be used to provide services, communicate with you, and maintain business records.
We never sell or share your data with third parties for marketing.

11. Governing Law

These Terms are governed by and interpreted in accordance with the laws of Scotland. Any disputes will be subject to the exclusive jurisdiction of the Scottish courts.

12. Agreement

By confirming your booking, signing an agreement, or making payment, you acknowledge that you have read and agree to these Terms.
